Terms of Service
These Terms of Service ("Terms") govern your use of LessThanTruckload.com (the "Site" and "Service"), operated by AW Internet Inc., a New Jersey corporation ("we," "us," or "our"). By using the Site, requesting quotes, or signing up, you agree to these Terms. If you do not agree, do not use the Service.
1. What we are — and what we are not
LessThanTruckload.com provides free tools (a freight-class calculator and educational guides) and a lead-matching service that connects shippers with independent, licensed freight brokers. We are not a freight broker, freight forwarder, or motor carrier. We do not arrange, book, quote, or transport freight, and we are not a party to any transportation or brokerage contract between you and a broker or carrier. We simply introduce interested parties. Any transportation services, rates, and agreements are solely between you and the broker or carrier you choose.
2. Freight class calculator
The calculator provides an estimated freight class based on the density you enter. It is for informational purposes only and is not a guarantee of final classification or cost. Carriers may reclassify freight upon inspection, and some commodities have fixed NMFC item numbers. Do not rely on the estimate as a binding classification or as billing documentation.
3. For shippers — quote requests
When you submit a quote request, you authorize us to share the information you provide with a limited number of independent freight brokers (typically up to three) so they may contact you with quotes. By submitting, you consent to being contacted by those brokers by email or phone regarding your request. We do not guarantee that you will receive any quote, a particular rate, savings, or that any broker will contact you. You are under no obligation to use any broker or accept any quote.
4. For brokers — lead purchases
When broker accounts are available, brokers who sign up agree to the following: leads are sold on a per-lead, non-exclusive basis (the same lead may be provided to more than one broker, typically up to three) at the prices presented at sign-up; charges accrue per lead and are billed to your saved payment method via Stripe on the schedule we disclose. We do not guarantee lead volume, quality, accuracy, or that any lead will convert. Brokers are solely responsible for their own compliance with all applicable laws when contacting shippers, including telemarketing/texting rules (such as the TCPA) and do-not-call requirements, and for holding any licenses required to operate as a broker. Leads may not be resold or redistributed.
5. Acceptable use
You agree not to misuse the Site — including submitting false or fraudulent information, scraping or harvesting data, interfering with the Site's operation, attempting unauthorized access, or using the Service for any unlawful purpose.
6. Intellectual property
The Site and its content (text, design, calculator, and guides) are owned by us or our licensors and protected by intellectual-property laws. You may use the Site for its intended purpose but may not copy, reproduce, or create derivative works from our content without permission.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, that estimates are accurate, or that any broker introduction will result in a satisfactory outcome.
8. Limitation of liability
To the maximum extent permitted by law, AW Internet Inc. and LessThanTruckload.com will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your dealings with any broker or carrier, your reliance on a freight-class estimate, or your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the 12 months before the claim, or US $100.
9. Indemnification
You agree to indemnify and hold harmless AW Internet Inc. and LessThanTruckload.com from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your dealings with brokers or carriers.
10. Third-party services
The Service relies on third parties (including Google, MailerLite, Brevo, and Stripe) and links to independent brokers. We are not responsible for third-party services or for the acts, omissions, quotes, or services of any broker or carrier.
11. Governing law
These Terms are governed by the laws of the State of New Jersey and applicable United States federal law, without regard to conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
12. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and we will revise the "Last updated" date above. Your continued use of the Site after changes means you accept them.
